Terms and Conditions
Butler Machinery Company
| • |
Butler Machinery Company will undertake
to carry out, at regular intervals, scheduled maintenance
to the product contracted, as established by the
manufacturer’s lubrication and maintenance
guidelines. Butler Machinery Company will provide
all fluid elements, fluid filters, gaskets, seals,
and fluids required for such servicing. |

Butler Machinery Company is responsible for intervals
of 250, 500, 1000 and 2000 hour maintenance and
inspections. No cleaning is included. |

Butler Machinery Company will undertake the implementation
of the Scheduled Oil Sample program during the recommended
service intervals. |
| • |
Butler Machinery Company will top off all fluids,
(excluding fuel), free of charge up to one gallon
per fluid type at each scheduled service interval.

Customer
| • |
The customer undertakes that the product
shall be made available to Butler Machinery Company
for services scheduled by agreement between Butler
Machinery Company and the customer. In the event
that the product is not made available to Butler
Machinery Company’s representative within
30 minutes of the arrival, the customer will pay
Butler Machinery Company in respect of waiting time
at Butler’s normal field service charge out
rate. |

Customer agrees to provide Butler Machinery Company
with accurate product hours/miles upon request or
at an established interval. |
| • |
Customer is responsible for cleaning, daily (10
hour) and weekly (50 & 100 hour) maintenance
and inspections. |
| • |
Customer agrees to comply with the product manufacturer’s
operation, lubrication and maintenance guidelines. |
| • |
In the event that any problems that affect product
operation occur, the customer agrees to contact
Butler Machinery Company as soon as possible. |
| • |
All quoted scheduled maintenance prices do not
include air filters. |
General
| • |
Travel costs are included and are
based on the location of the product with respect
to the nearest Butler Machinery Company store. In
the event that the customer relocates the product,
Butler Machinery Company reserves the right to increase
the charges to reflect any increase in cost to Butler
Machinery Company for attending the product at its
new location. |
| • |
Applicable local, state and federal taxes are
not included in prices, and will be added to each
invoice as they apply. |
| • |
This agreement covers preventive maintenance only.
All repairs including acts of nature, fire, theft,
vandalism, accident and abuse are specifically excluded
from this agreement. Fuel, tires, tire repair, ground
engaging tool replacement or repair, and undercarriage
repair are also excluded from this agreement. |
| • |
Prices are effective for term of contract, unless
otherwise stated. |
| • |
This agreement does not provide for a loaner or
replacement product. |
| • |
Either party may terminate this agreement with
30 days written notice. Failure to provide proper
notice at the agreement term will provide automatic
renewal at current scheduled service prices. |
